Collapse of Carlos Hill case indicates poor handling - Wilkinson

Queens Counsel Ian Wilkinson

Queens Counsel Ian Wilkinson has said the Carlos Hill case which collapsed this week is indicative of other court matters which have fallen apart due to poor handling.

Mr. Hill was freed on Wednesday after prosecutors said they did not have witnesses to prove a case that persons were induced to place money in Cash Plus.

Speaking on TVJ's Smile Jamaica on Friday morning, Mr. Wilkinson said he has seen injustices daily because of ill-preparedness on the part of the parties involved which have led to cases being extended for lengthy periods.

"(If the) DPP starts the proceedings, you have to be ready at all times; if you are not ready, don't start the proceedings... There is absolutely no case, for example, a case that affects so many in the public domain, that should last nine years," he asserted in response to the question of which party is to be blamed for the collapse of the case against Mr. Hill.

Mr. Wilkinson also lamented that of the thousands of investors who were affected by the scheme, only one was in the Home Circuit Court on Wednesday to give evidence.

He said many of them would have had several reasons for not coming forward to testify in the case -  two of which he cited were that they wanted to protect their identities, and secondly, they did not want Mr. Hill to go to jail because they felt he would not have been in a position to help them recover their monies.

However, he said these investors will have to take some of the blame for the case collapsing.
