INDECOM barred from charging cops with murder, providing false statement

The Supreme Court has ruled that the Independent Commission of Investigations (INDECOM) be barred from laying charges against two members of the Police Force.
    
Justice Brian Sykes, Supreme Court Judge, on Wednesday granted an injunction against INDECOM, barring it from charging two cops with murder and providing a false statement.
    
Justice Sykes also granted leave to Deputy Superintendent Everton Tabannah and Constable Worrell Latchman to challenge INDECOM before the Judicial Review Court.
    
INDECOM had served notice earlier this month that the two cops would be charged in connection with an incident in Montego Bay, St. James in 2012. 
    
The policemen had requested that INDECOM supply them with a report on how it arrived at the decision. INDECOM refused, citing the protection of potential witnesses.    
    
When contacted, Terrence Williams, Commissioner of INDECOM, said he would not comment on the judgement at this time. 
 
In the meantime, the ruling by Justice Sykes has opened the door for members of the Jamaica Constabulary Force (JCF) to challenge INDECOM on its refusal to provide witness statements.
    
RJR News has been informed that three policemen have filed similar appeals. Their applications will be heard in September.
